AGREEMENT made between:

PARTIES

1.    Jessy Mathenge of Universal Emigration Services Limited, at 16 Denvir Street, Strowan, Christchurch. (We/ Us/ Ourselves)

2.    The Client / You – means the person that has engaged the services of Universal Emigration Services Limited.

 

WE AND YOU AGREE:

1.    Our Services

1.1    As part of Our professional responsibilities We will provide You with a copy of the Licensed Immigration Advisers Code of Conduct 2010 (code of conduct). The Licensed Immigration Advisers Code of Conduct (the code of conduct) addresses the expected standards of professional and ethical conduct for licensed immigration advisers and must be observed.

1.2    We will:

Assess your situation solely based on the information you provide to us.

1.3    As part of this, We will:

        Provide You with practical immigration advice;

We will give you information to enable you make informed decisions and help you take the next step in your visa process.

 

2.    Our Fees

2.1    You will pay the following service fee(s) for the work described above:

            Our Initial Consultation fee (including GST)        $  120.00

2.2    Fees are payable before the consultation. Payments may be made online or over the phone.

 

3.    Invoicing

We will email you an invoice when services are completed in accordance with the terms of this contract.

4.    Refund Policy

4.1    Once the Service has been provided to you, we cannot and will not refund any fees, whether or not you have changed your mind or you no longer wish to utilise our service.

4.2    If you submit a written refund request through the Client Area or through the email within 8 hours of payment, you may be entitled to a refund if the Service has not yet been provided to you and/or work has not commenced on your profile.

4.3    We cannot and will not however, refund any fees or disbursements that have already been paid to third parties on Your behalf.

 

5.    Confidentiality

5.1    We will treat any personal information You give Us as confidential, and keep and maintain such information in accordance with the provisions of the Privacy Act 1993.

5.2    We will not disclose Your personal information without Your prior consent unless such disclosure is required for:

5.2.1    the purposes of the administration of the Immigration Advisers Licensing Act 2007;

5.2.2    the law requires Us to.

5.3    Your personal information will be retained for a period of seven years, and will be made available to the Immigration Advisers Authority if requested.

5.4    You have the right to have access to, and have corrected, any of Your personal information held by Us.

 

6.    Complaints procedure

6.1    If You have a complaint about Our services, please refer to the copy of Our internal complaints procedure which has been provided to you, and which set out how you can make a complaint to Us, and the process by which we will respond.

6.2    If You are not happy with Our response to Your complaint, and Your complaint is ‘eligible’ under the Immigration Advisers Licensing Act 2007, as set out at  15.4 below, You may send Your complaint to the Registrar of Immigration Advisers (the Registrar) at the Immigration Advisers Authority (the Authority):

6.3    Your complaint must be made in writing and specify the ground or grounds that form the basis of Your complaint against Us. You can use the Complaint Form (http://www.iaa.govt.nz/docs/complaint-about-adviser.pdf) provided by the Authority to make a complaint.

6.4    You can complain if You feel that We have demonstrated negligence, incompetence, incapacity, dishonest and misleading behaviour, or have breached the Licensed Immigration Advisers Code of Conduct 2010. These terms are further described in the Complaint Form which is available, together with other information on the complaints process, on the Immigration Advisers Authority website, at www.iaa.govt.nz

 

7.     Independent legal advice

7.1    You have the right to seek Your own legal advice about this agreement.

7.2    If You would like to obtain Your own legal advice, please do so before You sign the agreement

8.    Authority to act

8.1    This does not constitute an authority to act on your behalf in respect to your immigration situation.
